These Terms of Service (the "Terms") form a binding legal agreement between you and Mailboxx, Inc. ("Mailboxx", "we", "us") and govern your access to and use of our mobile apps, website at mailboxx.app, payment services, and the Mailboxx Card (collectively, the "Service"). By creating an account, downloading the app, or using the Service in any way, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to use the Service. By using the Service you represent that you (a) are of legal age, (b) have full power and authority to enter into these Terms, and (c) are not barred from using the Service under the laws of the United States or any other jurisdiction.
The Service is not available to users located in jurisdictions subject to comprehensive U.S. embargoes or otherwise on a U.S. sanctions list.
Mailboxx is a rewarded-email platform with two sides:
Mailboxx also provides a standard email inbox and the optional Mailboxx Card. We may add, modify, or remove features at any time. We will give reasonable notice of material reductions to paid features.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to (a) provide accurate, current, and complete information during registration, (b) keep your information up to date, (c) notify us immediately of any unauthorized use of your account, and (d) accept responsibility for all activities under your account.
The Mailboxx Card is a prepaid debit card issued by our partner bank and serviced through Stripe Issuing. Use of the Card is subject to a separate Cardholder Agreement which is presented before you activate the Card. You authorize Mailboxx to debit your Wallet balance for each Card transaction. The Card is non-transferable, and Mailboxx is not the card issuer.

Mailboxx uses automated and manual systems to detect fraud, click farms, and other forms of abuse. If we reasonably determine that engagement was fraudulent or violated these Terms, we may, at our discretion:
The Service, including all software, designs, text, graphics, logos, and the Mailboxx name, mark, and four-petal symbol, is owned by Mailboxx, Inc. and its licensors and is protected by U.S. and international intellectual-property laws. Except for the limited license expressly granted in these Terms, we reserve all rights. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.
You retain ownership of any content you submit (e.g., your profile photo, promotion creative as a sender). By submitting content, you grant Mailboxx a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for formatting), distribute, and display the content solely for the purpose of operating and improving the Service. You represent that you own or have the necessary rights to grant this license and that your content does not violate any third-party rights or applicable law.
The Service relies on third-party services (Stripe, Apple App Store, Google Play, cloud hosting, etc.). Your use of those services is governed by their own terms. We are not responsible for third-party services and disclaim liability for any acts or omissions of third parties.
If you obtained the app from the Apple App Store or Google Play, the Apple/Google "Application End User Licence Agreement" applies between you and the relevant store. To the extent of any conflict, those store terms govern as required by the platform.
You may stop using the Service at any time and request account deletion via the app or by writing to support@mailboxx.app. We may suspend or terminate your account immediately if we believe you have violated these Terms, posed a risk to the Service or other users, or as required to comply with law. On termination, your right to use the Service ends, but Sections 9 (Fraud & clawbacks), 10–11 (IP & Content), and 14–18 (Disclaimers, Liability, Indemnity, Disputes, Governing Law) survive.
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, Mailboxx disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected, or that the content, payouts, or analytics will be accurate or reliable.
To the maximum extent permitted by law, in no event will Mailboxx, its affiliates, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with the Service, even if advised of the possibility of such damages.
To the maximum extent permitted by law, Mailboxx's total aggregate liability for any claim arising out of or related to these Terms or the Service is limited to the greater of (a) the total amount you paid or received through Mailboxx in the 12 months before the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Mailboxx and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of (a) your access to or use of the Service, (b) your violation of these Terms, (c) your violation of any third-party right, including any intellectual-property or privacy right, or (d) any content you submit, post, or transmit through the Service.
Please read this section carefully — it affects how disputes are resolved.
You and Mailboxx agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, except that either party may bring small-claims actions in a court of competent jurisdiction. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in San Francisco County, California, unless the parties agree otherwise or applicable law requires a different venue.
You and Mailboxx waive any right to a jury trial. Class actions, class arbitrations, and representative proceedings are not permitted. Each party may only bring claims on an individual basis.
30-day right to opt out: you may opt out of the arbitration agreement by sending a written notice to legal@mailboxx.app within 30 days of first accepting these Terms.
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. Subject to Section 17, the federal and state courts located in San Francisco County, California have exclusive jurisdiction over any disputes not subject to arbitration.
If you are a consumer resident in the European Union, United Kingdom, or another jurisdiction whose mandatory consumer-protection laws override the above, you also have the protections of those laws, and nothing in these Terms limits any rights you have under such mandatory laws.
We may update these Terms from time to time. If we make material changes, we will notify you through the app, by email, or via a prominent notice on our website at least 14 days before the changes take effect, unless a shorter period is required by law. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
